Reservation Rental Deposit must be paid with a Visa or
MasterCard.

Security Deposit must be paid with a Visa and/or
MasterCard “Credit Card” (no debit, bank or pre-paid
cards) (must be a True & Verifiable Credit Card.) at the
time of pick-up.
**Remaining
balance of prepaid rent can be paid with Visa,
MasterCard or Cash at the time of pick-up.
** Any rent
and/or fees owed at the end of the rental term will be
charged to any customer Credit Card on file and/or taken
out of any deposit on file.
** Any
extension of the rental motorcycle return date will be
charged to any customer Credit Card on file and/or taken
out of any deposit on file.
** Insurance
will be prepaid via credit card by the customer directly
to the insurance company at the time of pick-up and
before the rental motorcycle is released. If there is
any authorized extension of the rental term, the
additional insurance premiums owed will be automatically
forwarded to the insurance company in advance of the
additional term.

Customer Orientation
** Every
customer will receive orientation on their rented
motorcycle. The customer orientation will cover all
aspects of safe motorcycle operation, the customer’s
maintenance responsibilities and local, state & federal
laws.

Renter
Requirements & Restrictions
** All
requirements & restrictions are for insurance purposes
and cannot be waived.

C.
Riders
** All
riders (including additional riders) must be at least 21
years of age & possess a valid motorcycle license
endorsement from any state or country of origin. One
additional driver is permitted (at an extra charge).
NOTE:
Additional driver must be present at time of rental
motorcycle pick-up to provide all necessary personal
documentation.
** Non
U.S. Residents must also possess a valid passport.
** Riders
may not take any of our motorcycles outside the state of
Florida without our written permission.
Note: All
of our motorcycles are equipped with a GPS tracking
devise.
Note: All
rental motorcycles taken out of the state of Florida
(with our permission) must be transported via trailer to
the special event state of intended use.
** All
rental motorcycles taken out of state (with our
permission) that incur any mechanical problem requiring
a repair will be 100% the sole responsibility of the
rental Customer to provide any such needed repair and to
pay for any and all repairs at the customers sole
expense. No repair will be reimbursed to the rental
customer by Freedom Motorcycle Rentals.
** Rentals
and security deposits must be secured by a Visa and/or
MasterCard.
** A
violation of any Requirements & Restrictions listed
within will void the Collision Damage Waiver and the
rental customer will be held 100% liable for all
damages.
** Rental
motorcycles are authorized for legal street use only and
are not allowed on tracks, gravel roads, beaches, dirt
roads, trails, or any other non-public roads.
**
Dangerous riding, reckless riding, illegal riding,
aggressive riding, stunt riding, stoppies, burnouts,
etc. or any other illegal abusive riding behavior is not
permitted on any of our rental motorcycles and any of
these activities will void the Collision Damage Waiver
and the rental customer will pay for any worn & damaged
parts and repairs.

D.
Reservations, Rental Deposit & Cancellation Policy
**
Reservations are highly recommended to insure
availability and the preferred motorcycle of your
choice.
** A rental
deposit of $50.00 per day, per bike will be charged on
the reservation date. This rental deposit will be
applied to the rental balance owed on the reserved
pick-up date.
** Freedom
Motorcycle Rental will confirm your reservation via
e-mail after the online customer reservation form has
been completed in full and the rental deposits have been
received and charged to the customers Visa and/or
MasterCard.
**
Motorcycles will be held for 30 minutes beyond the
scheduled pick-up time.

E.
Cancellations
**
Cancellations up to 30 days before the rental motorcycle
pick-up date will receive a full refund less a $50.00
processing fee.
**
Cancellations up to 10 days before the rental motorcycle
pick-up date will receive the full deposit amount
applied to a future rental.
Note:
Deposit credit is not transferable and must be used
within 12 months. Deposit credit will expire after 12
months.
**
Cancellations up to 48 hours before the rental
motorcycle pick-up date will be charged a cancellation
fee of $50.00 per day, per motorcycle.
**
Cancellations after 48 hours before the rental
motorcycle pick-up date will be charged a cancellation
fee of the total base rental rate for the contract.
** No shows
will be charged a cancellation fee of the total contract
invoice amount. No Exceptions!
**
Cancellations due to unmet rental requirements at the
time of rental pick-up (such as no motorcycle license,
inability to meet security deposit requirements, etc.)
are subject to a fee of 100% of the total invoice
amount. No exceptions!
** There are
no refunds for early motorcycle returns or unused
mileage.
** Once the
rental motorcycle has been picked up by the customer,
delivered to the customer or delivered to the location
as directed by the customer, the customer is 100%
responsible for the rental motorcycle for the entire
contract rental period.
** $39.00
(US) per hour or portion thereof will be charged to the
customers Visa and/or MasterCard or taken out of any
deposit for late returns commencing 15 minutes after
scheduled return time.

F.
Motorcycle Substitution
** Freedom
Motorcycle Rentals reserves the right to provide a
substitute motorcycle to replace the motorcycle
confirmed by the rental customer. At times this may
arise due to unexpected situations such as a late
return, damaged motorcycles or theft. Should Freedom
Motorcycle Rentals not be able to provide the confirmed
motorcycle a similar or better model will be provided.
This constitutes the maximum liability of Freedom
Motorcycle Rentals.

G.
Maintenance responsibility
** When the
rental motorcycle is in the care, custody, possession
and control of the customer, the customer is responsible
for maintenance, repairs and mishaps that are out of the
control of Freedom Motorcycle Rentals such as nails in
tires, punctured tires, checking engine oil levels at
each refueling, adding required oil and reporting
mechanical failures immediately. At all times the rental
customer is responsible for the safe & timely return of
the rental motorcycle and with the motorcycle in the
same condition as during the pre-rental inspection.
Instructions and procedures for maintenance expense
reimbursement are provided at pick-up. Customers may be
held responsible for mechanical damage due to negligence
in motorcycle operation or failure to provide normal
maintenance.

H.
Fuel &
Mileage
** Each
motorcycle rental includes 200 miles a day free and .20
cents each additional mile. Freedom Motorcycle Rentals
claims no responsibility for motorcycle fuel
consumption and/or mileage per gallon. Each motorcycle
is provided with a full tank of gas. A $55.00 charge
will be applied to customer’s credit card if the
motorcycle needs refueling of any amount. Customer must
use a 93 octane or higher when refueling.

I.
Limits
of liability
** Please
keep in mind that motorcycle riding is potentially
dangerous and can result in serious injury and even
death. Freedom Motorcycle Rentals does not
provide medical coverage of any kind. The rental
customers, additional drivers and any passengers do
hereby release Freedom Motorcycle Rentals of any and all
liability. It is the responsibility of the riders and
passengers to understand and accept all terms and
conditions outlined in the rental agreement, the
motorcycle rental release of liability, the acknowledged
assumption of risks, the collision damage waiver, the
passenger motorcycle rental release of liability forms
that are provided at the time of the rental motorcycle
pick-up and any and all additional forms, addendums,
agreements and contracts.

J.
Damage
Security Deposit
** A damage
security deposit of $1000.00 will be authorized at
pick-up. Damage security deposit must be processed via a
valid and true Visa and/or MasterCard credit card. The
transaction will be canceled upon the satisfactory
return of the undamaged rental motorcycle. We may use
your deposit to pay any amounts owed to us under this
agreement.

1.
Definitions
**
“Agreement” means all terms and conditions found in this
form. “You” or “your” means the person identified as the
renter on the Motorcycle Rental Agreement, any person
signing this Agreement, any Authorized Driver, Rider,
Passenger and any person or organization to whom charges
are billed by us at its or the renter’s direction. All
persons referred to as “you” or “your” are jointly and
severally bound by this agreement. “We”, “our” or “us”
means the independent business named within this
Agreement as Freedom Motorcycle Rentals. “Authorized
Driver” means the renter and any additional driver
listed by us on this agreement, provided that each such
person has a valid motorcycle or scooter drivers license
and, is at least 25 years of age unless the age
restriction is changed elsewhere in this Agreement.
“Vehicle” means the motorcycle identified in this
Agreement and any motorcycle we substitute for it, and
all its tires, tools, accessories, equipment, keys and
vehicle documents. “CDW” means Collision Damage Waiver.
“Physical Damage” means damage to, or loss of, the
Vehicle caused by collision or upset; it does not
include comprehensive damage, such as damage to, or loss
of, the Vehicle due to theft, vandalism, acts of nature,
riot or civil disturbance, hail, flood or fire. “Loss of
use” means the loss of our ability to use the Vehicle
for any purpose due to damage to it during this rental.
Loss of use is calculated by multi plying the number of
days from the date the Vehicle is damaged until it is
repaired, times the daily rental rate. “Proof “means
an original or a clear copy of a document to
substantiate the validity and current active status of
the document.

2.
Rental,
Indemnity and Warranties
** This is a
contract for the rental of the vehicle. We may repossess
the Vehicle at your expense without notice to you, if
the Vehicle is abandoned or used in violation of law or
this agreement. You agree to indemnify us, defend us and
hold us harmless from all claims, liability, costs and
attorney fees we incur from, or arising out of, this
rental and your use of the Vehicle. We make no
warranties, express, implied or apparent, regarding the
vehicle, no warranty of merchantability and no warranty
that the Vehicle is fit for a particular purpose.

3.
Condition and Return of vehicle
** You must
return the Vehicle to our rental office or other
location we specify, on the date and time specified in
this Agreement, and in the same condition that you
received it, except for ordinary wear. If the Vehicle is
returned after closing hours, you remain responsible for
loss of, and any damage to, the Vehicle until we inspect
it upon our next opening for business. Service to the
Vehicle or replacement of parts or accessories during
the rental must have our prior approval. You must check
and maintain fluid levels.

4.
Responsibility for Vehicle Damage or Loss;
Reporting to
Police
** You are
responsible for all damage to or loss of the Vehicle,
including the cost of repair, or the actual cash retail
value of the Vehicle on the date of the loss if the
vehicle is not repairable or if we elect not to repair
it, whether or not you are at fault. You are responsible
for theft of the Vehicle, loss of use, diminished value
of the Vehicle caused by damage to it or repair of it,
and a reasonable charge to cover our administrative
expenses connected with any damage claim, whether or not
you are at fault. You must report accidents or incidents
of theft and vandalism to us and the police as soon as
you discover them.

5.
Collision Damage Waiver
** Freedom
Motorcycle Rentals offers a C.D.W (collision damage
waiver) which is charged at $10.00 for each rental day
in advance of the release of the rental motorcycle that
will reduce the renter’s responsibility of the physical
damage from the entire value of the rental motorcycle
down to only $1000.00. If you purchase CDW, we will
waive our right to collect from you for a portion of
Physical Damage to the Vehicle. CDW is not insurance.
We will not waive this right if damage to the
Vehicle: ( a ) is caused by anyone who is not an
Authorized Driver, or by anyone whose motorcycle or
scooter driving license is suspended in any
jurisdiction; ( b ) is caused by anyone under the
influence of prescription or non-prescription drugs or
alcohol; ( c ) is caused by anyone who obtained the
Vehicle or extended the rental period by giving false,
fraudulent or misleading information; ( d ) occurs while
the Vehicle is used in furtherance of any illegal
purpose or under any circumstance that would constitute
a violation of law, other than a minor traffic
violation; ( e ) occurs while pushing or towing
anything, or in any race, speed test or contest, or
while teaching anyone to drive the Vehicle; ( f ) occurs
while carrying dangerous or hazardous items or illegal
material in or on the Vehicle; ( g ) occurs outside the
geographic limitations indicated within the Motorcycle
Rental Agreement; ( h ) occurs as a result of driving
the Vehicle on un paved roads; ( I ) occurs and the
odometer has been tampered with or disconnected; ( j )
occurs when the Vehicle’s fluid levels are low, or it is
otherwise reasonable to expect you to know that further
operation would damage the Vehicle; ( k ) is a result of
your willful, wanton or reckless act; ( L ) occurs and
you fail to immediately summon the police to any Vehicle
accident involving personal injury or property damage.

6.
Insurance
** State law
requires riders to possess liability insurance which is
charged at $15.00 each day in advance by our insurance
provider. This is paid by the customer directly to the
insurance provider at the time of pick-up and prior to
the release of the rental motorcycle. This required
liability (bodily injury and/or property damage you
cause to others) insurance is mandatory and provides
no coverage for collision caused by you. The
customer liability is for the entire value of the
motorcycle. A $1000.00 Visa and/or MasterCard credit
card damage security deposit is required by the customer
at the time of pick-up and prior to the release of the
rental motorcycle.
You are
responsible for all damage or loss you cause to others.
You agree to provide liability, collision and
comprehensive insurance covering you, us, and the
vehicle. Your insurance is primary to any insurance that
we may provide. If we are required by law to provide
liability insurance, we will provide a liability
insurance policy (the “Policy”) that is excess to any
other available and collectable insurance whether
primary, excess or contingent. The Policy will provide
liability insurance coverage with limits no higher than
the minimum financial amounts required by law of the
state whose laws apply to the loss. You and we reject
PIP, medical payments, no-fault and uninsured and
under-insured motorist coverage, where permitted by law.
All rental customers must provide any and all proof
(proof is defined as a copy of the policy declarations
pages and/or card) of primary vehicle insurance and
health insurance at the time of pick-up. All insurance
coverage and waivers are subject to the express terms of
the rental contract and do not include coverage for
personal property or damage as a result of negligence on
the part of the rental customers, additional riders
and/or passengers for any illegal use of the rental
motorcycle or any use under the influence of drugs
and/or alcohol. The rental rules must be complied with
at all times.

7.
Charges
** You will
pay us, or the appropriate government authorities, on
demand all charges due under this agreement, including:
( a ) time and mileage for the period during that you
keep the vehicle, or a mileage charge based on our
experience if the odometer is tampered with or
disconnected; ( b ) charges for additional drivers; ( c
) optional products and services you purchased; ( d )
fuel, if you return Vehicle with less fuel than when
rented; ( E ) applicable taxes; ( f ) all parking, and
toll fines, penalties, forfeitures, court costs, towing,
storage and impound charges and other expenses involving
the Vehicle assessed against us or the Vehicle; if
you fail to pay a traffic or toll charge to the charging
authority, you will pay us all fees owed to the charging
authority plus our administrative fee of $50.00 for each
such charge; ( g ) all expenses we incur in locating
and recovering the Vehicle if you fail to return it or
if we elect to repossess the Vehicle under the terms of
this agreement; ( h ) all costs, including pre- and
post-judgment attorney fees, we incur collecting payment
from you or otherwise enforcing our rights under this
Agreement; ( I ) a 2% per month late payment fee, or the
maximum amount allowed by law (if less than 2%), on all
amounts past due; ( j ) $25.00 or the maximum amount
allowed by law , whichever is greater, if you pay us
with a check returned unpaid for any reason; and ( k ) a
reasonable fee not to exceed $150.00 to clean the
Vehicle if returned substantially less clean than when
rented.

8.
Deposit
** We may use
your deposit to pay any amounts owed to us under this
Agreement.

9.
Your
Property
** You
release us, our agents and employees from all claims for
loss of, or damage to, your personal property or that of
any other person, that we received, handled or stored,
or what was left or carried in or on the Vehicle or in
any service vehicle or in our offices, whether or not
the loss or damage was caused by our negligence or was
otherwise our responsibility.

10.
Breach
of Agreement
** The acts
listed in paragraph 5 and C, above, are prohibited uses
of the Vehicle and breaches of this Agreement. You waive
all recourse against us for any criminal reports or
prosecutions that we take against you that arise out of
your breach of this Agreement.

11.
Modifications
** No term of
this Agreement can be waived or modified except by
writing that we have signed. If you wish to extend the
rental period, you must return the Vehicle to our rental
office for inspection and written amendment by us of the
due date. This agreement constitutes the entire
agreement between you and us. All prior representations
and agreements between you and us regarding this rental
are void.

12.
Miscellaneous
** A waiver
by us of any breach of this Agreement is not a waiver of
any additional breach or waiver of the performance of
your obligations under this Agreement. Our acceptance of
payment from you or our failure, refusal or neglect to
exercise any of our rights under this Agreement does not
constitute a waiver of any other provision of this
Agreement. Unless prohibited by law, you release us from
any liability for consequential, special or punitive
damages in connection with this rental or the
reservation of a vehicle. If any provision of this
Agreement is deemed void or unenforceable, the remaining
provisions are valid and enforceable.

Signing Agreement & Receiving Copies
** All
parties read, received copies of, and are in full
agreement with all the above listed terms, rules,
regulations, costs, rates, fees within this Agreement.
All parties agree to cooperate fully with each other in
a friendly and professional manner to execute this
rental Agreement to completion. Time is of the essence
to promptly complete this Agreement.
